Modes of Talaq Expression

Types of Ṭalāq
1. Based on Pronouncement (Revocability)
a) Ṭalāq Rajʿī (Revocable Divorce)
- Husband pronounces divorce (1st or 2nd time).
- Wife remains in ʿiddah, and the husband can reconcile without a new nikāḥ (marriage contract).
- Qur’an:
“And their husbands have more right to take them back in this [period] if they want reconciliation.” (2:228)
b) Ṭalāq Bāʾin (Irrevocable Divorce)
- Becomes final, reconciliation requires a new nikāḥ.
- Two subtypes:
- Minor Bāʾin: e.g., khulʿ, divorce before consummation.
- Major Bāʾin (Mughallaẓah): after the third divorce — the couple cannot remarry unless the wife marries another man genuinely, and that marriage ends (ḥalālah).
- Qur’an: “If he divorces her [the third time], then she is not lawful to him afterward until she marries a husband other than him.” (2:230)
2. Based on Compliance with Sunnah
a) Ṭalāq al-Sunnī (Lawful Divorce)
- Pronounced once in a state of purity (tuhr), during which no intimacy occurred.
- The wife observes ʿiddah, allowing reconciliation.
- This follows Qur’anic guidance (65:1).
b) Ṭalāq al-Bidʿī (Innovated Divorce)
- Pronounced in a prohibited way, such as:
- During menstruation.
- Multiple pronouncements at once (e.g., saying “I divorce you three times” in one sitting).
- Though it counts according to majority jurists, it is sinful.
3. Based on Expression
a) Ṣarīḥ (Explicit Divorce)
- Clear words like “I divorce you.”
- Counts regardless of intention.
b) Kināyah (Indirect Divorce)
- Words that could mean divorce or something else (e.g., “Go back to your family”).
- Requires intention to count as a divorce.

At Islamic Divorce & Khula, we believe that the divorce process should be handled with clarity, respect, and mindfulness to Islamic teachings. Whether you are applying for a Khula or seeking an Islamic divorce/talaq, our structured process ensures your case is managed professionally and compassionately from start to finish.
We have simplified the process into five key steps, each designed to give you peace of mind and support at every stage.
1. Submit Application
Complete the online Apply Now form with your details. You’ll be asked to provide personal information and some additional background of the relationship. If you wish to discuss your matter prior to submitting the application or at any stage in the future, please contact us via phone or email.
2. Fees
The fees for Khula are £350.00 and £300.00 if you are receiving estate benefits
3. supporting documents
We would require a copy of your ID, marriage certificate and payment before we can commence. If there are any police reports or existing court proceedings, please provide evidence of this. We will contact you if we require any additional information.
4. Eligibility Check
Our team reviews your submission to ensure it meets the basic eligibility criteria for Islamic divorce or Khula. We may contact you for any additional documentation.
5. Correspondence with Wife
We will then write to your wife and inform her of your decision regarding the talaq. We will provide you with a talaq document for you to send this will then be forwarded to your wife. We follow the preferred sunnah way of sending one letter, to your wife. This process will be repeated every month for 3 months.
6. Certificate Issued
As the preferred sunnah method has been followed the panel will issue a certificate confirming the talaq. This will be signed by the scholars and stamped.
